Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.

I was issued a new I-94 when my status changed to H1 and another one when i transferred my H1 to another employer. Will that be good enough or should I get in to the country with new I 94.

Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

Hi, I am a holder G4 visa working on a international institution in Washington DC, USA...and my fiance is a G4 visa holder too, working on other international institution in the same city (we are foreigners, south americans, especifically)...ok...the main issue is that we want to get married next month in USA and sure as G4 visa holders at that time....but on this September, my fiance is going to change his status to a F1 visa, because he is going to pursue his PHD on a US University....and I cannot change my status as dependent of him (F1 dependant), cuz I need to keep working, and I dont know if it is necessary for studying here to have exclusively F1 visa as a foreigner student, or he could become a G4 visa dependant from me, after he stop working to start studying.
...So my question is if we get married before that he changes his status from G4 to F1...would I be able to keep working on any international institution meanwhile he can keep his F1 student visa?, with no need to become a dependent from each other, but to keep, my G4 visa, and his future F1 visa, respectively?
My doubt is based on one comment that i heard from someone, but i am not sure, cuz that person told me, that if my husband changes his visa from G4, resigning my G4 dependent status, i couldn't be rehired later...i tried to get advide from a lawyer but his service is so expensive for me...so i hope someone can help me, cuz this issue is so important for us.

I don't think leave of absence nullify employer employee relationship. I checked this with my HR too when I was waiting for my EAD to be renewed. HR clearly told me that the only option was to terminate my employment in case my EAD was not renewed in time, and they would have opened the position and rehire me after receiving the physical EAD.

I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

There is no official documentation for to do's and to not do's without AP.
But folks have gone to India without the AP and then got it fedexed while In India and used it to get back to US.
My brother in law did the same. I am not aware of the potential issues he might face in the future but will post so when something happens.
use it at your own discretion.
