    My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .

    What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).

    I will greatly appreciate your reply.

    I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

    It's H-1B season and the business immigration attorneys at Fong & Chun are busy once again fielding phone calls and inquiries regarding employment-based visas, including those of L-1 and new company visas. In the past few years, the USCIS and US Department of Labor have suspected newer and small companies of fraud, especially within the immigration system. New procedures and increased scrutiny (http://www.immigrationvisaattorneyblog.com/2009/04/h1b-quota-still-open.html) of employment-based cases have made H-1B petitions and H-1B visas especially more difficult to attain.

    It's no secret that the USCIS, as part of the US Department of Homeland Security (USDHS) is engaged in "national security, fraud detection and prevention." The DHS now has an unit attached to it which investigates corporations suspected of defrauding the government specifically through the H-1B program and other visa categories.     1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

    The AC21 is for job description being same or similar.

    For example "Programmer Analyst" = "Computer Systems Analyst" as per the code mapping.. But if one takes "Senior Software Engineer" job.. with the same job description as per the approved labor which had title "Programmer Analyst"

    Experience should be AFTER you get your degree. Also, your experience with current employer cannot be counted unless the new opening is substantially different than your current position.

    You should be fine. Now that you have the receipt, you can start working for employer B. Some wait for the actual transfer to take place before working. It is a matter of preference. From what you have mentioned, your case seems to be pretty straight fwd and should not be an issue.

    Guys,

    I just got my approval (Mar 06, TSC), finally! The key issue that I am facing is that I am not in US at the moment and it is very difficult for me to return immediately.

    1. Is it okay that I come back after a month or so?

    2. Secondly, my AP is expiring later this month though I have H1B stamped till next year. The issue is that earlier this year I had used AP to enter US in spite of the fact that I had a valid H1B. DOES this invalidate my H1B visa? Can I use the H1B visa to enter US after my AP expires???

    Is there anything else I can do such as getting the cards fedexed to me and use them to enter US?

    Experts pl. advise�

    What happens if there is any future foreign travel planned and COS decision does not come in time. Will she have to wait to home country till decision is heard and then go for H4 stamping or she can anyways go for H4 stamping even if COS decision is pending?

    According to CIS ,they will take time upto 26th Oct ,just to issue the receipts. Again they say ,it might not be that longer but what I think we are not going to get the receipts anytime soon. At the same time we need not file another application if we dont hear anything from them till 15th of August,since we have the mail delivary proof that the application was accepted at TSC.
    So there is no other alternative but to wait for either a receipt or checks getting cashed...

    First of all, let me begin by congratulating the IV core team and other members on staging a dignified protest to the entire July VB fiasco!

    I have a question regarding the medical exam for the AOS. The civil surgeon I went to did not do a TB skin test and instead took an x-ray to verify no signs of TB. Has anyone else had the same experience, i.e. no skin test, x-ray only?

    The other strange thing he told me was that some of his patients send the x-ray as part of the 485 application. Has any1 else heard of anything like this?

    Last I checked, the USCIS did not employ medical personnel, but then what do I know?

    Any input from fellow IV members is greatly appreciated.

    Me and my wife received our EADs and our H1/H4 is valid till 2010.
    My wife is attending school being on H4. Since she has EAD, can she work part time(not in school) and keep the H4 status valid.
    Please suggest.
