    Hi Gurus -

    Am eFiling this my EAD renewal - and want to know what I should enter for -

    1. "What is Date for Application?" - is the "Received Date" in my EAD receipt?

    2. "Manner of Last Entry" : I put H1B - Speciality Occupation. Hope that is fine as I entered last year using H1B (am on H1B and there was one more H1 option there)

    3. Current Immigration Status - "I put H1B - Speciality Occupation".

    4. Eligibility Status - "I485 filed" - is that right? Am a July 07 filer.

    Sorry if these questions have been asked before - if yes, please point me to the thread and better please try to answer these ASAP.

    Hi,

    Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.

    In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
    Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

    Family 4th preference is retrogressed by a decade ( or two if you are from Philippines), so you may have to wait another 10 years to be eligible to file i-485.:confused:

    You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. Hope this helps.

    My H1-B was approved in octubre 2008, I would like to go to my home country but i don't have a visa to be able to come back.
    Now my question is:
    Having an approved H1-b is a warranty for me to get a visa to come back to the US.
    Also carry your educational docuements. They asked me last time when I went to stamping for my H1B Extension, in Feb 09. People over their in the Embassies looking in all means to stop giving the VISAs. So be prepared with all the documents.

    Hi

    Here is my situation . My visa status is H1b and i was laid off by a well-known software company and my termination date was 30th Oct 2009 .
    I approached a software consultancy and they filed a LCA petition on 3rd Nov 2009 and applied for H1b transfer on 10th Nov 2009 . They received the EAC petition number on 3rd December 2009 . Meanwhile they kept trying a project for me . I have following queries

    1. As i am not getting any salary from 1st Nov 2009 , what is my legal status ? Am i out of status and till what time i could stay here ? What could be effects if i stay here for long without project and salary?

    2. Am i entitled to get any salary from current company (software consultancy) ? If yes , when shall they start paying me ?Can they really force me legally to stay here without salary as they might have an excuse that H1 is still not transferred and i am not their employee right now ? I want to add one point here their offer letter states that starting date would be 1st Nov subject to legal H1 transfer.

    3. What are my legal rights if software consultancy company forces me to stay here without any pay stub ? Please tell me my options.

    I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.

    I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

    Your old visa stamp is good.

    option 3 as far as I know. You only renew the 6 year term if you are out of the US more than a year. And once you switch to a different visa category, your previous one does not matter for the cap. Its only if you are transferring from an existing H1B or renewing an existing H1B that the cap doesn't come into the picture.

    This question is for my friend. he has a Bcom (3 years bachlors from India) with certification of chartered accountant and cost accountant. He has a 6 years of post qualification experience in india (after ca and ) and now he has 6.5 years of experience in US. (Total post qualification experience is 11-12 years)

    His lawyer said as this is a 3 years degree you dont qualify for EB2. lawyer also send us a case where DOL denied CA plus 3 years of bcom under EB2.

    Can you help us if he qualify for EB-2, what is the best way to file.

    1. Can my wife apply for a visa after she starts using EAD? and later can she extend her H4 along with my H1 extension which I'm going to apply mid next year?

    Hi gurus,

    I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.

    1)Would this affect my I-140 processing

    2) Would this create any issues in the future stages of the green card process

    3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)

    HR of my Company screwed up with the content of the EB2 Ad posted in sunday newspaper. To save money they posted a partial AD with a link to the job listing on the companys website saying "Please goto this link for further information".....

    What is the minimum requirement for EB2? From what I read, it's BS+5yrs, or MS+1yr.

    EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

    1. Is there a rule that the experience should have been gained outside of the US?
    No

    2. Is there a rule that the number of years experience should be from an employer other than the petitioning employer?

But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

    Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.
    Everybody would be kept in the same backlog as we are. Illegal immigrants will stand in a que behind the legal immigrants. so you got the point
