Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.
A quick response would be greatly appreciated.
Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs

It's always good to have the right info on the form. If I remember correctly - you may request to correct the info 48 hours before your scheduled interview at the respective consulate or VFS (please double check).
I have had issues before with the online form i.e. my full address was not printed out correctly, in another situation I filled the form for my parents and forgot to sign the form (prepared by). There was never an issue. We all got VISA without a question

HI all,
I would like to have your opinion regarding my spouse visa, I applied for H1B visa in Cairo Egypt. I'm a female IT pro and got the visa with my 2 sons 5-2 years old. My husband was not given visa, VO never asked him any question and just stapled a paper to his passport to track his visa status online. I asked VO wheathre that means my husband was rejected, she said no just some delay, it takes some cases more time.
it has been one month since I did my interview in the consulate and nothing updated on that web site. My husband has his sister in USA with Green card. What do you think the situation will be? is it rejection or wil get visa later?

I filed my 485 in Aug 2007 (in the July fiasco), but filed my EAD in Jan 2008. So do I need to send the application fee.

I got an RFE (first time) for my 485 and my lawyer responded (sent it through post) on August, 9th, 2010. I am wondering, how long USCIS takes to update the status online? I just want to make sure USCIS received my RFE, that�s all I care.

I have to agree that the back ground is a bit distracting, but the petal is a very cool shot. If this were my shot I would try a few things in Photoshop to change it up. Like maybe make the background black and try black and white? Something like that may add something to it. Just a thought. Don't give up on it there's something there it just has to be found-:)!!

I am a July 07 filer. Recently I sent in EAD renewal application and got it approved within a month. When I saw my EAD card the Sex category on it was F instead of M. Now what are my option. Should I reapply for EAD or continue working on it. I changed my employer last month and am currently working on EAD.

Sorry I could not find answer for this question on any of the threads here. can anyone please answer the question below
"Copy of visa page of passport in color " is listed as one of the supporting docs for ead renewal.(in the IV thread on EAD self filing)
Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.
I had the same question so i spoke to my lawyer/attorney
she said that it is not necessary
infact in intial eveidence
1) copy of passport or DL or Visa Page or some national Id with picture
2) color photos
3) copy of 485 recipt or EAD
She said most of the attornies/lawyers are asking for extra documentations so that to pre-empt RFEs but she asked me to file with intial evidence that is asked on the instruction form i.e the three items i mentioned above.
I filed with those if they require additional evidence i will comply.

AC21: Job changed twice (Jun 06 and Apr 07). Sent EVL to USCIS both times with 'same job description' but 'different job title'.
This morning I received USCIS email alert for both my wife and I.
My I-485 application got a RFE. "We mailed you a notice requesting additional evidence". Will have to wait for the formal letter for the details. :(
My wife's I-485 application however was transferred to Newark NJ for interview. "This case has been sent for a standard interview." :confused:
I have a ton of questions at this stage. here are few in you gurus can help me while I am waiting for the RFE letter.
1) Will the RFE letter be mailed to me or my attorney ? what has been ur experience? do you get it in one week ?

Gurus , please provide me your input. I am little bit tense. It will help me alot. Also in the Copy the number from alien card what should I put. Since I am on the H1B visa, but I do have EAD also. Any help in this regard is higly appriciable.

Of course you can start PERM in your 6th year. Make sure you do it soon and file for I-140 promptly so that once that is approved you can get 3 yr H1 approval

I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?
